Infowars host Owen Shroyer was sentenced to 60 days in prison for connections to events related to January 6, 2021.

Although he pleaded guilty to a Class A Misdemeanor of “Entering and Remaining in a Restricted Building or Grounds,” Shroyer did not enter the U.S. Capitol.

During his sentencing hearing, Shoryer told the court he was “not a part of any larger plan for illegal activity or violence that day.”

Prosecutors appear to be targeting Shroyer for his speech.

According to the Department of Justice (DOJ), Shroyer “helped create January 6,” because he “stoked the flames of a potential disruption of the certification vote by streaming disinformation about alleged voter fraud and a stolen election to thousands, perhaps millions, of viewers of his program on InfoWars.”

reported that a court document alleged that his influence led others to enter the Capitol building, claiming, “Shroyer did not step foot inside the Capitol, he did not need to; many of those who listened to him did instead.”

Instead, Shroyer and Infowars founder, Alex Jones, warned against entering the Capitol.

In a reply to the government’s sentencing memorandum, it is noted that Shroyer has “every right to believe, and to assert to this very day, that the 2020 election was stolen. He can assert that the Justice Department is in the thrall of shadowy deep state figures intent on stifling freedom of speech and crushing dissent in the name of some crippling form of conformity.”

The document describes various statements protected under the First Amendment, stating that political opinions, beliefs, and expressions fall “well within the long-established protected contours of freedom of speech, even speech called extremist by those claiming a smug orthodoxy.”

Because of a deferred prosecution agreement Shroyer signed after being arrested in 2019 for interrupting a congressional hearing, he was forbidden from using "loud, threatening, or abusive language, or to engage in any disorderly or disruptive conduct, at any place upon the United States Capitol Grounds."
